Fault or No Fault?

Pennsylvania family law does not require that one party be at fault as grounds for granting an uncontested divorce. In most divorces, fault will not be a factor, but it can be a consideration in a judge's decision to grant spousal support and alimony, and in cases where one spouse does not agree to a divorce (which is a contested divorce).

Issues to be Decided in Divorce

Almost every divorce will involve decisions regarding the division of marital assets and debt. You may already have significant agreement about property division, but it is important to talk with a lawyer who can explain your rights and help you with a proper valuation and distribution of your marital assets. This will be particularly important if there is a family-owned business or complex assets.

  • If you have decided these issues in advance in a premarital agreement, there may be little to dispute.
  • If there is a significant difference in income between the two parties, or if one member of the couple stayed home to raise children and has no income or a diminished earning capacity, then entitlement to spousal support, temporary alimony, child support and alimony will likely be an issue.
  • If there are children in your family, then child custody will need to be resolved either by agreement of the parties or, if necessary, by the court. Child support will also need to be addressed.
